1. A. Except as otherwise provided by law, the proceedings of the Board are confidential and that confidentiality may not be waived by the parties.
2. B. The Office of Administrative Hearings’ proceedings involving the adjudication of a Board formal disciplinary action and the administrative law judge’s recommended decision are confidential.

3. C. The respondent may not waive the confidentiality of the:

   1. (1) Proceedings; or
   2. (2) Patients whose medical records or care are reflected in the record of the proceedings.

4. D. To the extent possible, even after the close of a formal disciplinary action, the parties shall refrain from revealing the identity of any patients involved in the matter, including but not limited to, information contained in:

   1. (1) Legal documents; or
   2. (2) Oral statements.
