The Board shall grant the application for a dispensing permit if:

1. A. The applicant meets the requirements of Regulation .04 of this chapter;
2. B. The applicant has not been sanctioned by the Board for dispensing drugs without a permit within the last 5 years; and
3. C. Granting the application is in the public interest.
