1. A. Upon receipt of a complaint, the administrative personnel shall present the complaint to the Complaint Committee of the Board.
2. B. The Committee shall review the complaint and make a determination as to whether the complaint falls within the Board's jurisdiction.
3. C. If the Committee determines that the complaint does not fall within the Board’s jurisdiction, the determination shall be reported to the Board at its next regularly scheduled Board meeting. If the Board concurs with the recommendation of the Committee, the Board shall vote to close the complaint with no Board action.
4. D. If the Board determines that the complaint falls under the jurisdiction of another agency, the Board staff shall refer the complaint to the appropriate agency.
5. E. If the Committee determines that the complaint would fall within the Board’s jurisdiction, the Board shall vote to open the complaint for investigation.

6. F. The Committee shall review the licensee's response or report and make a recommendation to the Board for disposition of the case. The Committee may request that:

   1. (1) Supplemental information be obtained;
   2. (2) A supplemental investigation be conducted; or
   3. (3) Clarification of the responses or report be received.

7. G. The complaint committee shall, by a majority of the members present at a regularly scheduled Committee meeting, make a recommendation to the Board based on the following actions:

   1. (1) That the Board take informal action by issuing one of the following:

      1. (a) Cease and desist letter;
      2. (b) Educational letter;
      3. (c) Informal meeting;
      4. (d) Letter of admonishment; or
      5. (e) Letter of dismissal; or
   2. (2) That the Board take formal action by voting to charge the licensee with a violation of the Act and subsequently making a referral of the case to the Attorney General's Office for prosecution.
