If the therapeutic nursery provides transportation, the therapeutic nursery program shall ensure that:

1. A. Vehicles used for the transport of therapeutic nursery enrollees are in compliance with the requirements outlined in Transportation Article, Title 22, Annotated Code of Maryland;

2. B. Each driver:

   1. (1) Possesses a valid Class D license; and
   2. (2) Presents the driver's record, certified by the Motor Vehicle Administration, showing not more than two points, at the time of employment and annually after that; and
3. C. In addition to the driver, at least one staff member is present in the vehicle to supervise the children at all times.
