1. A. A person shall obtain a license from the Department before operating a group home.

2. B. The Secretary shall grant a license to an applicant to operate a group home, as described in Regulation .02 of this chapter, if the applicant fulfills the requirements for:

   1. (1) Licensure under this chapter;
   2. (2) Administrative requirements under COMAR 10.21.17;
   3. (3) Psychiatric rehabilitation programs under COMAR 10.21.21; and
   4. (4) Residential rehabilitation programs under COMAR 10.21.22.
