1. A. A registration certificate is not transferable.

2. B. A registration certificate becomes void when the registrant:

   1. (1) Dies;
   2. (2) Discontinues business or professional practice in the State; or

   3. (3) Changes ownership, including when:

      1. (a) Partners are added or deleted from the partnership;
      2. (b) There is a change in the president or chief executive officer of the corporation; or
      3. (c) There is a change in the ownership of 10 percent or more of the outstanding shares in the corporation.

3. C. A registrant who discontinues business or professional practice in the State shall:

   1. (1) Notify the Secretary in writing;
   2. (2) Surrender the registrant’s current registration certificate; and
   3. (3) Legally transfer or dispose of any controlled substances relative to the registrant’s operation.

4. D. A registrant who changes ownership of the business or professional practice shall:

   1. (1) Notify the Secretary in writing at least 30 days before the change occurs;
   2. (2) Complete and submit a change of ownership application to the Department;
   3. (3) Pay the change-of-ownership fee in Regulation .06 of this chapter;
   4. (4) Surrender the registrant’s current registration certificate after the ownership change is finalized; and
   5. (5) Allow the Department to inspect the business or professional practice of the new owners.

5. E. A registrant who changes the location of a registrant’s place of business or professional practice shall:

   1. (1) Notify the Department at least 30 days before there is a change in the location of the registrant’s place of business or professional practice;
   2. (2) Apply to amend a current registration certificate; and
   3. (3) Pay the fee to amend a certificate in Regulation .06 of this chapter.

6. F. During the 3-year registration period, the registrant shall notify the Office of Controlled Substances Administration within 30 days of the following:

   1. (1) Any criminal convictions;
   2. (2) Any disciplinary actions taken against the registrant’s professional or occupational license; or
   3. (3) Any disciplinary actions taken against the registrant’s federal Drug Enforcement Agency registration.

7. G. After an application for registration has been filed, the Secretary may:

   1. (1) Inspect the place of business or professional practice described in the application; and
   2. (2) Investigate the applicant to determine whether the applicant meets the requirements of this chapter.
8. H. The registrant shall inform the Office of Controlled Substances Administration prior to any address changes.
