- A. This chapter governs health permits for outdoor musical festivals, as set forth in Business Regulation Article, §§17-1401 — 17-1407, Annotated Code of Maryland.
- B. In addition to a health permit, a person who wants to be a promoter of an outdoor musical festival shall obtain a safety permit and a promoter license in accordance with Business Regulation Article, §§17-1401 — 17-1407, Annotated Code of Maryland.
C. This chapter applies only:
- (1) If admission is charged to attend the outdoor musical festival;
(2) To an outdoor musical festival with 500 or more spectators in attendance for:
- (a) Carroll County;
- (b) Frederick County;
- (c) Kent County;
- (d) Queen Anne's County; and
- (e) Washington County; and
(3) To an outdoor musical festival with 1,000 or more spectators in attendance for:
- (a) Anne Arundel County;
- (b) Baltimore County;
- (c) Calvert County;
- (d) Caroline County;
- (e) Cecil County;
- (f) Charles County;
- (g) Dorchester County;
- (h) Garrett County;
- (i) Harford County;
- (j) Prince George's County;
- (k) Somerset County;
- (l) St. Mary's County;
- (m) Talbot County;
- (n) Wicomico County; and
- (o) Worcester County.
D. This chapter does not apply to an outdoor musical festival held in:
- (1) Baltimore City;
- (2) Allegany County;
- (3) Howard County;
- (4) Montgomery County;
- (5) Carroll County by a college or public school; or
- (6) Kent County by a nonprofit agricultural, charitable, civic, fraternal, religious, social welfare, or war veterans' organization operating in Kent County.
