1. A. The term of an exemption shall be in conjunction with a health care practitioner's professional license renewal and shall be renewed at the same time the health care practitioner's professional license is renewed.
2. B. The exemption expires at the end of its term, unless the exemption is renewed in accordance with this regulation.
3. C. An exempted health care practitioner, on renewal, shall meet all the requirements of this chapter at the time of renewal.
4. D. Each health care practitioner who has been exempted by the Secretary from the prohibition on self-referral as an essential health care entity needed for access to health care shall renew the health care practitioner's exemption status in the manner provided by the Department at the time of licensure, certification, or other form of practice renewal authorized under the Health Occupations Article, Annotated Code of Maryland, within the time period specified on the form.

5. E. At a minimum, the health care practitioner shall provide, at the time of renewal, to the Department:

   1. (1) A copy of the initial exemption request;
   2. (2) A copy of the Secretary’s approval of the initial exemption;
   3. (3) The items specified in Regulation .05B of this chapter; and
   4. (4) Any additional pertinent information as requested by the Secretary.
6. F. Each exempted health care practitioner shall keep the appropriate licensing, certification, or other practice authorizing board apprised of the health care practitioner’s current business address.
7. G. On request by the Department, the relevant board or boards shall supply the current business addresses of exempted health care practitioners.
8. H. The Department shall mail a notice of the required renewal to the health care practitioner at the current business address supplied by the appropriate board.
9. I. If an exempted health care practitioner does not receive notice of renewal, it is the exempted health care practitioner's responsibility to notify the Department so that the Secretary may renew the exemption before the expiration of the current exemption.

10. J. Failure to Renew Exemption.

    1. (1) If an exempted health care practitioner fails to renew the exemption, the practitioner is not considered exempted under the Health Occupations Article, §1-301(d)(5), Annotated Code of Maryland.
    2. (2) If an exempted health care practitioner fails to renew the exemption, and fails to carry out the agreed requirements set forth in Regulation .05B(6) of this chapter, the practitioner shall be subject to disciplinary action as set forth in Health Occupations Article, §1-307, Annotated Code of Maryland, for violation of the self-referral laws.
