- A. If the Commission determines that an association is failing to exercise reasonable diligence in preparing a new racetrack to begin racing on the date approved by the Commission, the Commission may revoke its approval of the applicant and reopen the application process.
- B. If the Commission takes action against an association under §A of this regulation, that association may not participate in the application process that is reopened.
