1. A. A project shall comply with the Coast Smart Construction Program if it meets the criteria in §B of this regulation.

2. B. The applicable Coast Smart Construction Program criteria are:

   1. (1) The project is a capital project;
   2. (2) The project is located within the Coast Smart boundary, as indicated on the Coast Smart Map;

   3. (3) The project includes:

      1. (a) The construction of a new structure;
      2. (b) The reconstruction of a structure with substantial damage; or
      3. (c) The construction of a new highway facility;
   4. (4) At least 50 percent of the total project costs are funded with state funds; and
   5. (5) The total project cost is $500,000 or more.
