1. A. An obligor may contact the support enforcement agency to arrange a written arrearage payment schedule agreement.
2. B. The support enforcement agency shall attempt to negotiate with the obligor to reach a mutually acceptable agreement.

3. C. The arrearage payment schedule agreement shall:

   1. (1) Provide for the:

      1. (a) Payment of the full amount of arrearage at the time of the agreement, or
      2. (b) Reduction of the total arrearage to less than the payments required in a 120-day period;
   2. (2) Establish a time limit for the payment of the full amount of the arrearage;
   3. (3) Provide for payment of the total amount of arrearage owed based on the obligor's ability to pay; and

   4. (4) Be signed by the:

      1. (a) Obligor, and
      2. (b) Representative of the local support enforcement agency.

4. D. The agreement shall state that to be in compliance, the obligor shall:

   1. (1) Pay the current support amount;
   2. (2) Comply with the arrearage payment schedule agreement;
   3. (3) Make all payments on or by the due date of each payment; and
   4. (4) Comply with all other court orders and support payment agreements.
5. E. The support enforcement agency may petition the court to enter a court order that includes the terms of the agreement.

6. F. The Administration may forward to the licensing authority a request for suspension or denial of the obligor's license or make a referral under Regulation .06 of this chapter if:

   1. (1) An arrearage payment schedule agreement is not reached; or
   2. (2) The obligor fails to comply with an agreement.
