1. A. All individuals included in the RCA unit shall meet the requirements as described in Regulation .03 of this chapter.

2. B. The LDSS:

   1. (1) Shall include childless refugee married couples in the same assistance unit, unless one member receives SSI; and
   2. (2) May not include in the same assistance unit adult refugees related to one another such as brothers and sisters.

3. C. The assistance unit may not include:

   1. (1) An individual who fails to meet technical factors of eligibility as described in Regulation .03 of this chapter;

   2. (2) An individual who is fleeing to avoid prosecution or custody or confinement after conviction for a crime or an attempt to commit a crime, which is:

      1. (a) A felony under the laws of the place within the United States from which the individual is fleeing; or
      2. (b) In the case of New Jersey, a high misdemeanor under the laws of that state;
   3. (3) An individual violating a condition of probation or parole imposed under federal or state law;
   4. (4) An individual convicted of IPV as described in Regulation .17B of this chapter;
   5. (5) An institutionalized individual; or
   6. (6) An SSI recipient.
