1. A. A custodian of a record shall deny a request for disclosure:

   1. (1) If the disclosure requested is contrary to any:

      1. (a) State or federal statute or regulation,
      2. (b) Maryland Rule of Procedure, or
      3. (c) Court order;

   2. (2) Of a personnel record including, but not limited to an employee's:

      1. (a) Letters of reference, and
      2. (b) Home address or telephone number;
   3. (3) Of information concerning the security of an information system;
   4. (4) Of a trade secret or confidential commercial information; and
   5. (5) Subject to §B of this regulation, of information about the licensing of an individual.

2. B. Licensing Records. Only the following information may be disclosed from a licensing record:

   1. (1) A licensee's:

      1. (a) Name,
      2. (b) Business address, or, if the business address is not available, the home address,
      3. (c) Business telephone number,
      4. (d) Educational and occupational background,
      5. (e) Professional qualifications;
   2. (2) Findings and orders that result from formal disciplinary actions;
   3. (3) Evidence that has been provided to the custodian to meet the requirements of a statute regarding financial responsibility;
   4. (4) Other licensing information which the official custodian determines should be disclosed to fulfill a compelling public purpose; and
   5. (5) Except for the identity of a reporter of any allegation of child abuse or neglect, or of abuse, neglect, self-neglect, exploitation of a vulnerable adult, information requested by a licensee who is the subject of the requested record.
