OAH may deny or dismiss an appeal if:

1. A. The appeal request is not effective pursuant to Regulation .03 of this chapter;
2. B. The appellant withdraws the request in writing;
3. C. As provided in Regulation .11 of this chapter, the appellant fails to appear at the scheduled hearing;
4. D. Assistance has been reduced or terminated due to a change in federal or State law or regulation and the appeal does not concern misapplication of the change; or
5. E. The appellant has failed to pay any filing fees required by OAH.
