A nonprofit organization or local jurisdiction shall meet the following requirements to qualify for a grant under the Program:

1. A. Have the legal capacity to enter into the grant agreement;
2. B. Satisfy all legal requirements to operate in the State; and

3. C. Meet the performance standards of the Department, as follows:

   1. (1) Not have defaulted on a prior loan or grant from the Department, including a default by failure to complete a project funded by a grant made under the Program within the required time period; and
   2. (2) Not be currently barred or suspended from any of the Department's programs.
