The Secretary may waive or vary particular provisions of this chapter if:

1. A. The waiver is consistent with the Act;
2. B. Any necessary approvals from HUD are obtained; and

3. C. The Secretary determines that:

   1. (1) An emergency exists; or
   2. (2) The application of a regulation in a specific case would be inequitable or contrary to the purposes of the Act.
