1. A. The Program shall determine the level of lead abatement treatment for each residential dwelling unit, and the type of work to be done.

2. B. The four levels of treatment are:

   1. (1) Level I, which includes:

      1. (a) Installing caps of vinyl, aluminum, or any other material in all window wells, in order to make window wells smooth and cleanable, in a manner and under conditions approved by the Department,
      2. (b) Removing and repainting chipped, peeling, or flaking paint on exterior and interior painted surfaces,
      3. (c) HEPA-vacuuming and washing of the interior of the property with high phosphate detergent or its equivalent, as determined by MDE, and
      4. (d) Educational and other requirements of the Program;

   2. (2) Level II, which includes all of the following:

      1. (a) Any Level I treatment,
      2. (b) Stripping and repainting, replacing, or encapsulating all interior windowsills with vinyl, metal, or any other material in a manner and under conditions approved by the Department,
      3. (c) Except for a treated or replacement window that is free of lead-based paint on its friction surfaces, fixing the top sash of all windows in place in order to eliminate the friction caused by movement of the top sash,
      4. (d) Rehanging all doors where necessary in order to prevent the rubbing together of a lead-painted surface with another surface,
      5. (e) Making all bare floors smooth and cleanable, and
      6. (f) Ensuring that all kitchen and bathroom floors are overlaid with a smooth, water-resistant covering;

   3. (3) Level III, which includes:

      1. (a) Any Level II treatment,
      2. (b) Window replacement, and abatement of exterior window trim,
      3. (c) Doorway treatments such as use of sealants and encapsulants following reworking and removal of peeling paint,
      4. (d) Stairway treatments such as enclosure of treads and risers, and
      5. (e) Encapsulation or enclosure of designated wall and trim surfaces;
   4. (4) Level IV, which consists of one of the other levels of treatment combined with new and innovative techniques, as approved for the project by the Program Director and MDE.
