1. A. Except as provided in §C of this regulation, the Secretary may charge a fee for:

   1. (1) The replacement of a lost security card;
   2. (2) The failure of a State employee to surrender the employee's security card upon separation from State employment or demand under Regulation .04B of this chapter; or
   3. (3) The failure of an individual other than a State employee to surrender the individual's security card upon demand under Regulation .04E of this chapter.

2. B. The fees established for security cards are:

   1. (1) Lobbyist — $50;
   2. (2) Contractor — $50; and

   3. (3) Replacement fees as follows:

      1. (a) First loss — $50;
      2. (b) Second loss — $100; and
      3. (c) Each successive loss — $250 subject to authorization from DGSP.

3. C. The Secretary may not charge a fee:

   1. (1) To replace a damaged security card, if the damage was unintentional and the security card is surrendered; or
   2. (2) To issue a security card with updated personal or employment information.

4. D. The Secretary may:

   1. (1) Deduct from the wages due a State employee any fee that may be owed under this chapter; and
   2. (2) Deduct from any monies due an individual other than a State employee any fee that may be charged under this chapter.
