The provisions of Regulation .04 do not apply to the sale of:

1. A. Food, perishable goods, goods which are custom made, or which are custom-altered at the request of the consumer; or
2. B. Goods which cannot be resold by the merchant because of any valid law or regulation promulgated by a governmental body.
