1. (a) Each contractor and subcontractor subject to this subtitle shall pay each employee not less than the prevailing wage rate required under this subtitle:

   1. (1) unconditionally;
   2. (2) without subsequent rebate; and

   3. (3) except as provided in subsection (b) of this section, without deductions for:

      1. (i) food;
      2. (ii) sleeping accommodations;
      3. (iii) transportation;
      4. (iv) use of small tools; or
      5. (v) any other thing of any kind.

2. (b) A contractor or subcontractor may make deductions that are:

   1. (1) required by law;
   2. (2) required or allowed by a collective bargaining agreement between a bona fide labor organization and the contractor or subcontractor; or

   3. (3) contained in a written agreement between an employee and an employer undertaken at the beginning of employment, if the agreement:

      1. (i) concerns food, sleeping accommodations, or other similar items;
      2. (ii) is submitted by the employer to the public body awarding the public work contract; and
      3. (iii) is approved by the public body as fair and reasonable.
