1. (a) This section does not apply to capital expenditures:

   1. (1) for public school construction under Title 5, Subtitle 3 of the Education Article; or
   2. (2) by the Department of Transportation or the Maryland Transportation Authority, in connection with State roads, bridges, or highways.

2. (b) Before execution, a contract for a capital expenditure other than in connection with a State correctional facility, St. Mary's College of Maryland, Morgan State University, or the University System of Maryland shall be:

   1. (1) reviewed by the Secretary of General Services; and
   2. (2) except as provided in § 12-203 of this subtitle and § 13-108 of this article, after that review, approved by the Board.

3. (c) Before execution, a contract for a capital expenditure in connection with a State correctional facility shall be:

   1. (1) reviewed by the Secretary of Public Safety and Correctional Services; and
   2. (2) except as provided in § 12-203 of this subtitle, after that review, approved by the Board.

4. (d) Before execution, a contract for a capital expenditure in connection with the University System of Maryland shall be:

   1. (1) subject to the provisions of Title 4, Subtitle 4 of this article;
   2. (2) approved by the Board of Regents of the University System of Maryland; and
   3. (3) approved by the Board of Public Works.

5. (e) Before execution, a contract for a capital expenditure in connection with St. Mary's College of Maryland shall be:

   1. (1) subject to the provisions of Title 4, Subtitle 4 of this article;
   2. (2) approved by the Board of Trustees of St. Mary's College of Maryland; and
   3. (3) approved by the Board of Public Works.

6. (f) Before execution, a contract for a capital expenditure in connection with Morgan State University shall be:

   1. (1) subject to the provisions of Title 4, Subtitle 4 of this article;
   2. (2) approved by the Board of Regents of Morgan State University; and
   3. (3) approved by the Board of Public Works.

7. (g) The Board shall supervise the expenditure of any money that the General Assembly appropriates for:

   1. (1) buildings;
   2. (2) equipment;
   3. (3) new construction; or
   4. (4) any other capital expenditure.
