1. (a) In this subtitle the following words have the meanings indicated.

2. (b)

   1. (1) “Employee” means an employee (as defined in § 5-101 of this title) or former employee when the individual may be exposed under normal operating conditions or foreseeable emergencies.

   2. (2) “Employee” includes:

      1. (i) a line supervisor;
      2. (ii) a maintenance worker;
      3. (iii) a member or former member of a volunteer fire, ambulance, or rescue company;
      4. (iv) operating personnel; and
      5. (v) a production worker.

3. (c)

   1. (1) “Employer” means an employer (as defined in § 5-101 of this title) and includes a volunteer fire, ambulance, or rescue company.

   2. (2) “Employer” does not include a farmer who:

      1. (i) uses a hazardous chemical in farming; and
      2. (ii) complies with the applicable requirements of the Federal Insecticide, Fungicide, and Rodenticide Act.¹
