1. (a) Except as provided in subsection (b) of this section, this title applies to the working conditions at each work place in the State.

2. (b) This title does not apply to a working condition of:

   1. (1) an employee of the federal government or its units; or

   2. (2) an employee whose occupational safety and health is protected under:

      1. (i) the Federal Mine Safety and Health Act of 1977;¹
      2. (ii) the Longshore and Harbor Workers' Compensation Act;² or
      3. (iii) the Atomic Energy Act of 1954.³
