1. (a) With the approval of the Governor, the Secretary shall appoint a deputy secretary.
2. (b) The deputy secretary shall be an individual with a disability, if the Secretary is not an individual with a disability.

3. (c) The deputy secretary:

   1. (1) serves at the pleasure of the Secretary; and
   2. (2) is entitled to the compensation provided in the State budget.
4. (d) The deputy secretary has the duties provided by law or delegated by the Secretary.
