1. (a)

   1. (1) If a person knowingly violates any provision of this subtitle or any regulation adopted under this subtitle, the Board may impose a fine not to exceed $500,000.

   2. (2) Before the Board imposes a fine, the Board shall consider the appropriateness of the fine in relation to:

      1. (i) The size of the wholesale distributor;
      2. (ii) The gravity of the violation for which the fine is to be imposed;
      3. (iii) The good faith of the wholesale distributor; and
      4. (iv) Any previous violations by the wholesale distributor.
2. (b) In addition to the penalty provided in subsection (a) of this section, the Board also may take disciplinary action against a permit holder who is convicted of or pleads guilty or nolo contendere to a violation of State, federal, or local drug laws.
