1. (1) is at least 35 years old;
2. (2) has worked for the individual's family in the family home;
3. (3) is not gainfully employed;
4. (4) has had, or would have, difficulty in securing employment; and

5. (5) has depended on:

   1. (i) the income of a family member and has lost that income as the result of separation, divorce, or the death or disability of that family member; or
   2. (ii) government assistance as the parent of a dependent child and is no longer eligible for that assistance.

In this subtitle, “displaced homemaker” means an individual who:
