Whenever the Secretary finds that an emergency exists, the Secretary may order the impoundment of any source of ionizing radiation that is in the possession of any person:

1. (1) Who is not equipped to meet the requirements of this subtitle or the rules and regulations adopted under this subtitle; or
2. (2) Who violates the provisions of this subtitle or the rules or regulations adopted under this subtitle.
