1. (a) To qualify for a barbershop permit, an applicant shall be a person who meets the requirements of this section.

2. (b)

   1. (1) An applicant shall own the facility in which the barbershop for which the application is made is located.

   2. (2) To qualify for a barbershop permit for a mobile barbershop, the applicant shall:

      1. (i) hold a barbershop permit to operate a barbershop that is not a mobile barbershop; and
      2. (ii) own or lease the motor vehicle or trailer in which the mobile barbershop for which the application is made is located.

3. (c) An applicant shall satisfy the Board that the location and equipment of the barbershop for which the application is made meets the requirements of:

   1. (1) the Board;
   2. (2) the Maryland Department of Health; and
   3. (3) the applicable local zoning code.
4. (d) As a condition of the issuance of a barbershop permit, the barbershop for which the application is made shall pass a pre-opening inspection conducted under § 4-512 of this subtitle.
