1. (a) There is a basket of cheer permit.
2. (b) The Board may issue the permit to a nonprofit organization, as defined by § 501(c) of the Internal Revenue Code, that meets the requirements of this section.

3. (c) The permit authorizes the permit holder to provide as a prize at a benefit performance a basket of cheer, consisting of:

   1. (1) for a holder of a Class C per diem beer and wine license, not more than:

      1. (i) 288 ounces of beer; and
      2. (ii) 2.25 liters of wine; and

   2. (2) for a holder of a Class C per diem beer, wine, and liquor license, not more than:

      1. (i) 288 ounces of beer;
      2. (ii) 2.25 liters of wine; and
      3. (iii) 2.25 liters of liquor.
4. (d) The alcoholic beverages contained in a basket of cheer shall be for off-premises consumption.

5. (e) The permit fees are:

   1. (1) $30 per event for the holder of a Class C per diem beer and wine license; and
   2. (2) $45 per event for the holder of a Class C per diem beer, wine, and liquor license.
