1. (a) A person engaged in the manufacture or sale of alcoholic beverages, an agent or employee of the person, or a license holder may not, directly or indirectly, offer or make a payment or gift to:

   1. (1) a member of the Board;
   2. (2) an employee of the Board; or
   3. (3) a person acting on behalf of a member or an employee of the Board.
2. (b) A person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000.
