1. (a) There is a Class B Cafe beer and wine license.

2. (b)

   1. (1) The Board may issue the license for use by a cafe if:

      1. (i) the Board determines that the cafe has adequate tables, chairs, food, and facilities for preparing and serving meals;
      2. (ii) the average gross monthly receipts from the sale of cooked or prepared food served at the cafe and other items approved by the Board exceed 50% of the average monthly receipts from the sale of beer and wine sold for on-premises consumption; and
      3. (iii) not more than 10% of the total square footage of the cafe is dedicated to the public display of beer and wine that are offered for sale.
   2. (2) The Board shall set a maximum and a minimum seating capacity for the cafe.

   3. (3) The license:

      1. (i) authorizes the license holder to sell beer and wine 7 days a week at a cafe, at retail, at the place described in the license, for on-and off-premises consumption;
      2. (ii) has a wine tasting privilege for on-premises consumption for every day of the year; and
      3. (iii) may be used for off-premises catering.
3. (c) The Board shall set the maximum number of cafe licenses that it may issue under this section.
4. (d) The annual license fee is $1,575.
