1. (1) the Board determines that the licensed premises is seasonally operated; and

2. (2) the license holder submits a written request to the Board at least 30 days before:

   1. (i) the anticipated date of closing; and
   2. (ii) the anticipated date of reopening.

The Board may authorize the closing of a licensed premises for not more than 9 months if:
