1. (a) This section does not apply to:

   1. (1) a restaurant not located in a hotel or motel; or
   2. (2) a catering establishment.
2. (b) There is a Class B-BWL (H-M) license.

3. (c) The Board may issue the license for use by a hotel or motel that has:

   1. (1) a dining room with facilities for preparing and serving regular meals for at least 125 individuals at one seating;
   2. (2) at least 100 rooms for the accommodation of the public; and
   3. (3) a capital investment of not less than $500,000.

4. (d)

   1. (1) The annual license fee is $10,108.

   2. (2) In addition, the license holder annually shall pay:

      1. (i) $1,000, if the licensed premises has fewer than 100 rooms;
      2. (ii) $500, if the license holder provides live entertainment; and
      3. (iii) $200, if the license holder provides outdoor table service.
