1. (a) The Department may issue a permit to an applicant that satisfies the requirements of this subtitle.

2. (b) The Department may not issue a permit to an applicant if the Department determines that an applicant cannot utilize food processing residuals without:

   1. (1) Causing undue risk to:

      1. (i) The environment; or
      2. (ii) Public health, safety, or welfare; or
   2. (2) Otherwise violating this subtitle.
