EFSB Consolidated Permit Decisions.

- (1) Final Decision. The Board shall approve, approve with conditions, or reject each Application for an EFSB Consolidated Permit. The final decision of the Board for an EFSB Consolidated Permit shall be as described in 980 CMR 13.10. The Board shall include findings described in 980 CMR 2.06(3): Required Findings. The Board shall give due consideration to the substantive standards of applicable permitting statutes, regulations, and guidance of the PEAs. If approved, the Board shall issue an EFSB Consolidated Permit in the form of a composite of all individual Permits otherwise necessary for the construction and operation of the CEIF Project pursuant to M.G.L. c. 164, §§ 69T-69V, inclusive.
- (2) Zoning Exemptions. Zoning exemptions, if granted by the Board, shall be issued as part of the final decision for an EFSB Consolidated Permit.
- (3) Permits. The Board’s issuance of an EFSB Consolidated Permit shall be a composite of all Permits that would otherwise be necessary for the Construction and operation of a CEIF Project.
- (4) Conditions Applicable to the CEIF Project. The Board shall state each condition and Permit requirement applicable to the CEIF Project. The Board shall identify the entity with jurisdiction to enforce each condition and Permitting requirement.
