1. (1) Final Decision Includes Conditions. The Board may include conditions in its final decision on a Consolidated Permit.
2. (2) Common Conditions. The Board shall establish Common Conditions. The Board’s Common Conditions shall include those listed in 980 CMR 13.00: EFSB Consolidated Permit Application Guidance, Attachment 1: Common Conditions and Requirements for EFSB Consolidated Permits.

3. (3) Conditions Applied by the Board in a Final Decision. Conditions in the Tentative Decision on a CEIF Project, may include, but are not limited to:

   1. (a) Conditions proposed by the Applicant in its Application. 980 CMR 13.05(1).
   2. (b) Conditions proposed by PEAs in a statement of recommended Permit conditions and those proposed by Parties. 980 CMR 13.07(5).
   3. (c) Presiding Officer Recommended Permit Conditions and Requirements. 980 CMR 13.07(6). In issuing the final decision, the Board may adopt, reject, or modify the conditions proposed

in the Tentative Decision.

1. (4) Conditions Applied by the Board in a Constructive Approval. The Board shall apply conditions in a Constructive Approval pursuant to 980 CMR 17.00: Constructive Approvals.
