Pursuant to M.G.L. c. 66, § 10, an agency shall disclose upon request, without the consent of the data subject,

any personal data which is a public record as defined in 950 CMR 33.04. Questions as to whether a particular record is a public record shall be resolved as provided in 950 CMR 32.00, et seq. and 950 CMR 33.16 through 33.17.
