Prior to the award of a Major Contract under M.G.L. c. 30, § 39M½, a Public Agency must either select a Private Sector Owner's Representative pursuant to 945 CMR 4.06 or designate an Employee Owner's Representative pursuant to 945 CMR 4.07. A Major Contract shall be null and void if an Owner's Representative is not selected or designated prior to its execution.
