Effect of Reconsideration

- (1) If the Commissioner denies a request for reconsideration, the denial shall be final and is not subject to appeal under any provision of M.G.L. c. 151A.
- (2) If the Commissioner allows a request for reconsideration or reconsiders a decision on his/her own motion, he/she shall reopen the original hearing giving notice to all parties to the original hearing. The reopened hearing shall be conducted in accordance with the procedures prescribed by M.G.L.
- c. 151A, § 12 or M.G.L. c. 151A, § 39(b), whichever is applicable.
(3) If the Commissioner reopens the original hearing, benefits shall be paid or denied in accordance with the original decision until such time as a new decision is issued.
