Pursuant to M.G.L. c. 21O, § 8, any violation of any provision of M.G.L. c. 21O or 310 CMR 80.00 or of any order, permit, or approval adopted or issued thereunder shall be presumed to constitute irreparable harm to public health, safety and welfare, and to the environment. Such presumption may be rebutted by the introduction of competent evidence.
