Penalties

  1. (1) General. A person who or which violates the provisions of M.G.L. c. 111, § 150A or 310 CMR 19.000 is subject to judicially imposed criminal and civil penalties as well as civil administrative penalties imposed by the Department. Each day that a violation occurs or continues constitutes a separate violation.

  2. (2) Penalties.

    1. (a) A violation may be punished under the statute by the imposition of a penalty that does not exceed $25,000 for each day of violation.
    2. (b) A violation may be punished pursuant to the provisions of M.G.L. c. 21A, § 16, and 310 CMR 5.00: Administrative Penalty, by the administrative imposition of a penalty of no less than $100 and not more than $25,000 for each day of violation.
    3. (c) A violation may be punished under the statute by a fine of not more than $25,000, or by imprisonment for not more than two years in a house of correction.
  3. (3) Punishment. Punishment imposed under the statute is in addition to any other penalty prescribed by law.
