No person shall construct, operate, maintain, expand or modify a facility to store, process, transfer, treat or dispose of solid waste except in accordance with:

1. (1) a valid site assignment;
2. (2) a solid waste management facility permit ("permit") and any applicable facility expansion permit issued in accordance with 310 CMR 19.032;
3. (3) an authorization to construct the facility issued by the Department in accordance with 310 CMR 19.041;
4. (4) an authorization to operate the facility issued by the Department in accordance with 310 CMR 19.042 or, for a transfer station which is not a C&D waste transfer station, a certification in accordance with 310 CMR 19.035; and
5. (5) any applicable modification permit pursuant to 310 CMR 19.033 or 19.034.
