1. (A) A member who meets all eligibility criteria set forth in 130 CMR 437.000, 130 CMR 450.000: Administrative and Billing Regulations, and all other applicable federal and MassHealth regulations may elect to receive hospice care during one or more of the following election periods:

   1. (1) an initial 90–day period;
   2. (2) a subsequent 90–day period; or
   3. (3) an unlimited number of subsequent 60–day periods.
2. (B) The election periods are available in the order listed and may be elected separately at different times.
3. (C) A member may continue to receive hospice services through the initial 90-day election period and the subsequent election periods without interruption if the member remains in the care of the hospice provider and does not revoke the election under 130 CMR 437.412(C).
