The Division at its discretion may purchase, at the following rates of payment, oxygen and respiratory therapy equipment that is being provided on a monthly rental basis.

1. (A) If the Division exercises the option to purchase the equipment within three months from the date of delivery of the equipment, 70% of the total rental payments shall be applied toward the maximum allowable purchase price computed in accordance with 130 CMR 427.423(A) and (B).
2. (B) If the Division exercises the option to purchase the equipment any time after three months from the date of delivery of the equipment, 70% of the first three monthly rental payments and 50% of all subsequent monthly rental payments shall be applied toward the maximum allowable purchase price computed in accordance with 130 CMR 427.423(A) and (B).
