Persons Eligible for Compensation

(1) Persons Eligible. The following persons are eligible for compensation:
- (a) Victims as defined in 124 CMR 2.03;
- (b) Dependents and family members of homicide victims;
- (c) Persons who assume homemaker responsibilities as provided for in 124 CMR 2.06(7)(e);
- (d) Persons who actually incur burial expenses directly related to the death of a victim in accordance with 124 CMR 2.06(2) or (3);
- (e) Parent or legal guardian in accordance with 124 CMR 2.06(5);
- (f) Persons who incur the costs of "Crime Scene Cleanup services" in accordance with 124 CMR 2.06(11); and
- (g) Persons who incur the costs of "Security Measures" in accordance with 124 CMR 2.06(13).
- (h) Persons or entity that incurs the costs for Forensic Sexual Assault Examinations as defined in 124 CMR 2.03.
- (2) Estates. The estate of a victim is not eligible for compensation.
- (3) Awards and Compensation Governed. Applications reviewed by the Agency for awards or compensation issued on or after July 1, 2025 shall be governed by 124 CMR 2.00.
