Obstruction or Retaliation

- (1) Termination of Employment. Any department or provider employee that obstructs an investigation conducted under M.G.L. c. 19C or 115 CMR 9.00, or retaliates against any person for making a complaint, complying with M.G.L. c. 19C or 115 CMR 9.00 or cooperating with an investigation, shall be subject to discipline, up to and including dismissal.
- (2) Revocation of Contract, License, or Other Action. Any provider that obstructs an investigation conducted under M.G.L. c. 19C or 115 CMR 9.00, or retaliates against any person for making a complaint, complying with M.G.L. c. 19C or 115 CMR 9.00 or cooperating with an investigation, shall be subject to adverse action including, without limitation, termination of the Department’s contract with the provider and revocation of the provider’s license.
