The Department may waive the application of any provision of 105 CMR 125.000 with respect to a particular case when in its opinion the enforcement thereof would do manifest injustice, provided that:

1. (A) The party requesting a waiver shall submit written documentation supporting its request; and
2. (B) The decision of the Department to grant a waiver shall not conflict with the purpose of 105 CMR 125.000 and shall not pose a risk to public health or safety.
