1. A. Pursuant to R.S. 3:4278.6, any person conducting timber harvesting operations with the intent to cut five acres or more of timberland shall enter into a written contract or agreement with the owner, purchaser, or an agent or representative of either the owner or the purchaser of such timberland.

2. B. The written contract or agreement for conducting timber harvesting operations shall contain the following:

   1. 1. term of timber harvest;
   2. 2. obligations of both parties;
   3. 3. amount or quantity;
   4. 4. payment; and

   5. 5. description of timber harvest:

      1. a. location of tract such as a plat map;
      2. b. type of harvest such as clear cut or thinning;
      3. c. species and product such as pine log or hardwood logs; and
      4. d. final destination of species and product
3. C. The written contract or agreement must be signed by both parties, and a fully executed copy must be provided to all parties prior to harvesting.
