1. A. If any dam or impoundment structure is determined to be unsafe, the Director of Public Works and Flood Control, pursuant to R.S. 38:21-28, shall direct any such repairs or remediations for a dam or impoundment structure as he deems necessary to insure that life and property are not unduly threatened by the impoundment. such remedial action may include:

   1. 1. direction that the water level behind the structure be lowered to a safe level; or
   2. 2. that the impoundment be completely drained until all necessary corrections to the structure have been made.
