- A. When the owner fails to plug an abandoned water well within the time period specified in §517, the department, upon receiving information on the existence of such well, will order the owner to plug the well within
30 calendar days after receipt of the order. - B. If the owner fails to comply within the 30-day time period or does not offer, in writing, an acceptable alternative time interval for plugging the well, the owner will be considered in violation of R.S. 38:3094, which permits a civil penalty of not more than $1,000 a day for each day of violation and for each act of violation.
